Powerboat.LONDON is a trading name of Focus Marine Training Ltd. which offers RYA Accredited Training in London, operating from Chiswick Pier.

COURSE DELIVERY

All candidates must complete an electronic registration form in advance of joining the course via the link within the booking confirmation email. Detailed joining instructions will be sent via email to candidates including a checklist of “What to bring” – please read this in advance of attending! 

ENGLISH LANGUAGE PROFICIENCY Candidates must have a working knowledge of English (to CEFR B2 level or equivalent). All tuition is delivered in English and no translation will be provided or permitted. Candidates cannot bring (or book a course place for) a friend/family member to translate. If you are at all unsure about whether you meet the language requirements, please call us on 020 8138 0888 for an informal discussion prior to booking your course place. We regrettably cannot offer refunds to candidates who are unable to complete the course syllabus due to a lack of proficiency in English. 

RISK STATEMENT

It must be recognised that powerboating is by its nature an unpredictable sport and therefore inherently involves an element of risk. By taking part in an RYA Powerboat Course (the Course), you agree and acknowledge that:

(i) You are aware of the inherent element of risk involved in the sport and you accept responsibility exposing yourself to such inherent risk whilst taking part in the Course;

(ii) You will comply at all times with the instructions of the Course Instructors particularly with regard to handling of boats, wearing of buoyancy aids or lifejackets and the wearing of suitable clothing for the conditions;

(iii) You accept responsibility for any injury, damage or loss to the extent caused by your own negligence;

(iv) You will not participate in the Course if your ability to participate is impaired by alcohol, drugs or if you are otherwise unfit to participate;

CANCELLATION

You understand that the Chief Instructor may cancel or postpone the Course at any stage in the event of bad weather, equipment failure, illness or otherwise. 

Candidates with places on a course cancelled by the Chief Instructor will be offered the choice of a full refund, or exchange for alternative course dates (subject to availability). 

MISCONDUCT

You understand that the Course lead instructor or centre principal may exclude anyone from a particular session and evict anyone from the premises who refuses to comply with these Booking Terms or who misconducts themselves in any way or who causes damage or annoyance to staff, other candidates or third parties. 

DRUGS AND ALCOHOL

We are committed to ensuring that our activities are carried out in a safe way. As part of this commitment, we recognise that alcohol and other substances can affect judgement and performance and must, therefore, be seen as a potential threat to the safety of individual instructing staff, participants, and – in some situations – with consequent risk to others.

Under PLA byelaws, the master of a vessel (including recreational vessels) shall not navigate when unfit by reason of drink or drugs e.g. having 25 micrograms of alcohol or more in 100 millilitres of breath. Any course participant who is considered to be unfit for participation in training activities due to alcohol or drugs (whether illegal or not) or to substance abuse will be liable to be removed immediately from that course and their place shall be forfeited on any remaining session(s). Whether or not a course participant is fit to participate in training activities is a matter for the reasonable opinion of the lead instructor.

Under the Misuse of Drugs Act 1971, the possession, use or supply of illegal drugs is a criminal offence. When it is suspected that such an offence has been committed, the centre principal shall consider whether it is appropriate to contact the police. 

No participant should attend when unfit to participate due to alcohol or drugs (whether illegal or not) or to substance abuse.

SMOKING

We operate a strict NO SMOKING policy across all locations, including the use of vapes and e-cigarettes. This includes all indoor and outdoor teaching spaces, including the public pontoon and when aboard training vessels.

Course participants and instructors are only permitted to smoke during breaks when off-site. Smoking is not permitted whilst wearing lifejackets. 

MINIMUM CANDIDATES

With the exception of 1-to-1 (Solo) course bookings, all standard and group courses require a minimum of two candidates in order to run. In the event that you book onto a standard or group course as a single candidate: if, within 24 hours of advertised course start, no further candidates have booked, you will be offered the choice of either alternative course dates (subject to availability) or a full refund.

Course places are extremely limited and there is currently very high demand upon our services. 

As such, if you book a course place with us, we offer a cancellation policy as detailed below:

You can cancel your course place(s) within 14 days of booking and receive a full refund, as long as the course is not due to start within 14 days at the time of cancellation.

If your course is due to start within the next 14-days, the course fee(s) are 100% non-refundable unless we can sell your place(s), in which case we will refund your course fee(s) in full, less a £25 administration fee.

If you request a cancellation more than 14 days after booking and more than 14 days before the start of the course, we will re-advertise your place(s). If we can find candidate(s) to fill your course place(s) more than 14 days before the course begins, we will issue you with a full refund, less a £25 administration fee. If we cannot find alternative candidate(s) to fill your place(s) within 14 days of the course start date, we will offer you the option of either a 50% refund or the option to re-book with us on an alternative date (subject to availability).

If your course includes a self-guided eLearning component or virtual classroom sessions, the first date of accessing or joining these materials and/or electronic resources and/or remote classroom sessions will be deemed as the start date of the course, after which point the course fees will be non-refundable.

Please ensure that you leave enough time to arrive in advance of the start time for each session, including setting up and testing any computer/WiFi connections if your session is taught in a virtual environment. We cannot accommodate late entry to our sessions, either virtually or face-to-face, as this causes significant disruption to other candidates.

Any candidates who are not present in attendance at the advertised start time for each session (as indicated in the course joining instructions) will need to re-book to attend that session (and any subsequent sessions) at a later date, at additional cost and subject to availability.

An RYA course completion certificate will be awarded to each candidate upon successful demonstration of competence against all syllabus requirements as applicable to the syllabus each taught course or assessment. For RYA Photocard certificates (e.g. RYA Powerboat Level 2 courses), each candidate will need to bring a physical passport-style photograph depicting a likeness of the candidate (within a frame size W: 22mm x H: 32mm) with them, as per the course joining instructions. Photocard certificates cannot be awarded until a suitable physical photograph is presented. 

Candidates who wish to apply to the RYA for an ICC (International Certificate of Competence) should familiarise themselves with the application process and confirm their eligibility for the issue of an ICC by the RYA in the UK prior to booking an RYA Powerboat course. In the UK, ICCs are issued by the RYA. We will not accept any liability for candidates who do not meet the eligibility requirements for international certification issued by the RYA, nor the validity of RYA certificates for candidates’ intended purpose(s). Candidates shall be responsible for checking local regulations regarding certification required (e.g. to charter or skipper a vessel) especially when boating abroad. 

ICC applications can have lengthy turnaround times and candidates are advised to check the RYA’s website for the latest guidance and information (https://www.rya.org.uk/knowledge/abroad/icc). At certain times, the RYA may offer a Fast-track scheme whereby, for an additional fee, certification applications can be expedited. We have no influence over, and will not be held responsible for: any delays in external certification lead times (including RYA ICC applications), the costs or fees associated with ICC applications or other external application processes, the availability of performance of third parties (including but not limited to external certification bodies or issuing authorities such as the RYA certification department), the availability/performance/additional costs incurred when using fast-track certification schemes, or any technical issues or loss of applications with external certification application processes. 

Some RYA certificates are only valid when registered electronically (e.g. RYA Powerboat scheme certificates). We endeavour to register RYA certificates electronically within 24 hours of award (often sooner). Candidates will receive an email confirming that their certificate has been registered as soon as this has been processed. 

The information you provide when booking will be used solely to process your booking and to attend to your safety for the duration of the course. By accepting these terms and conditions, you agree for Powerboat.LONDON to share your data with Focus Marine Ltd. in order to process your course booking. Focus Marine Ltd. has a Data Privacy Policy which can be found at www.focusmarine.co.uk/privacy. Your information will be stored by Focus Marine Ltd. and used in accordance with this policy.

On successful completion of your RYA Powerboat 2 course your name, contact details, date of birth, certificate number and date of issue will shared with the RYA through a secure web portal on www.rya.org.uk. The data will be stored on the RYA’s central database. This information allows the RYA to record your qualification, to update any records they may hold for you, and to verify or replace your certificate if required. For further information on how the RYA will deal with your data, please see the RYA’s privacy policy at www.rya.org.uk/go/privacy.

Gift Voucher delivery. Printed (display) vouchers are dispatched by Royal Mail (1st Class), and we aim to process these within 2 working days of purchase. Email copies are available upon request (at no additional charge).

Gift/Promotional Voucher redemption. Course places must be pre-booked. Vouchers can only be redeemed online at www.powerboat.london, or when making a purchase by telephone with Focus Marine. Vouchers cannot be redeemed retrospectively, for example to obtain refunds against existing (paid for) course bookings. Vouchers are only valid with Powerboat.London (Focus Marine) and cannot be redeemed at other RYA Training Centres.

All Vouchers carry a code or serial number which must be quoted when dealing with us, and must be kept securely. We cannot accept responsibility for any loss you may incur as a result of theft, impersonation or identity fraud. 

Course availability. Powerboat.London makes no guarantee of availability on courses at the point of purchase of a gift voucher. Spaces are only secured once a course has been booked, so it is recommended that you book as early as possible to avoid disappointment.

The participant is free to book their preferred course place within the Voucher Validity Period (as defined below), subject to availability. Course places are subject to availability and, in some cases, may be subject to weather conditions. To avoid disappointment, we recommend that bookings are made well in advance. We strongly advise that you do not make any travel, accommodation, or other arrangements until you have received confirmation of your booking.

Voucher validity period. Gift vouchers are valid for a period of 12 months from the date of purchase. Vouchers cannot be redeemed after expiry date.

Refunds. Vouchers are non-refundable other than within the 14 day cancellation period as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. All physical and electronic vouchers have a nominal cash value of £0.01. Where the purchase cost of a voucher exceeds the value of the RYA Powerboat course place it is redeemed against, we will accept applications for refunds of the balance paid (ie. where a gift voucher purchased at £475 is redeemed against course place advertised at £450, this would result in eligibility for a £25 refund). 

Standard Powerboat Gift Course vouchers are valid only against Standard powerboat course bookings made at www.powerboat.london; these cannot be used against Solo or Group course booking(s), or combinations thereof.

Group Powerboat Gift Course vouchers are valid only against Group powerboat course bookings made at www.powerboat.london; these cannot be used against Standard or Solo course booking(s), or combinations thereof.

Solo Powerboat Gift Course vouchers are valid only against Solo powerboat course bookings made at www.powerboat.london; these cannot be used against Standard or Group course booking(s), or combinations thereof.

Subject to availability, we would be happy to consider the redemption of a voucher(s) against alternative course types – enquiries will be considered on a case-by-case basis at the discretion of the Principal or Chief Instructor, whereby, if permitted, bookings shall only be confirmed upon remittance of payment of the balance of any amount payable where applicable.

Lost or stolen vouchers. Lost, stolen or destroyed gift vouchers cannot be exchanged or refunded. 

Cancellation. In the unlikely event that a course needs to be cancelled by Powerboat.London, Cancellation terms shall apply (see above). In the event that a participant cancels a course booking that was booked by redeeming a voucher, cancellation rebooking fees shall apply as per the Cancellation terms, however voucher purchases shall not be eligible for partial or full refunds (where otherwise applicable) but bookings may be transferred where the conditions of the Cancellation terms are met. 

Promotional Offers

Where a promotional offer or discount is advertised, the following terms shall apply: 

  1. The promotion is valid only for the specified time period, as mentioned in the offer. After that time period has elapsed, the regular pricing will apply. 
  2. The discount cannot be combined with any other offer, discount scheme or promotion. 
  3. Unless otherwise stated, the promotion can only be applied to standard courses at full retail price. 
  4. The discount is only applicable to purchases made through the website during the promotional period, and cannot be applied to purchases made through any other channel. The promotional discount can only be redeemed by entering a valid code into the checkout at the point of purchase, and cannot be redeemed retrospectively for completed orders. 
  5. The discount is not redeemable for cash or any other form of payment.
  6. We reserve the right to modify, cancel or discontinue the promotion at any time without prior notice.
  7. We reserve the right to refuse any order that is believed to be fraudulent, unauthorised or in violation of these terms and conditions.
  8. We reserve the right to limit the number of voucher redemptions per customer. 
  9. All purchases are subject to the terms and conditions of the website, including its privacy policy, refund policy and cancellation policy (see above).
  10. Discounts shall be applied to the checkout total and only one discount shall be applied per order.
